1. Service Description

LeadHarvest provides automated lead follow-up and text messaging services for service businesses. By using our service, you agree to these terms.

2. Account Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Ensuring your use of the service complies with applicable laws
  • Obtaining proper consent before adding leads to automated messaging

3. Messaging Compliance

You agree to comply with all applicable messaging laws including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act. This means:

  • Only messaging leads who have provided prior express consent
  • Honoring opt-out requests promptly
  • Not sending messages for illegal or deceptive purposes
  • Maintaining records of consent as required by law

Your messaging activity is subject to the rules of the US wireless carriers and The Campaign Registry (TCR). Violations of carrier rules may result in messages being filtered, your campaign being deactivated, or your account being suspended.

4. Billing & Subscription

LeadHarvest is currently offered to a limited group of businesses through a founder-assisted onboarding. Pricing and billing terms are agreed with you before your account is activated; plans are billed monthly thereafter.

You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months.

5. Message Limits & Usage

Each plan includes a set number of text messages per month. Messages beyond your plan limit are charged at the per-message rate stated in your plan — there is no public pricing page while LeadHarvest is in early access. Unused messages do not roll over between billing periods.

6. Text Messaging Terms

LeadHarvest sends SMS text messages on behalf of the businesses that use it. A person receives messages only after giving express consent on that business's own lead-capture form, and consent is collected separately for each business.

  • Message frequency varies and depends on the conversation. These are service messages about a specific enquiry, not recurring marketing blasts.
  • Message and data rates may apply. Your mobile carrier's standard rates apply to messages you send and receive.
  • Reply STOP to any message to stop them. STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT and REVOKE work the same way. Opt-outs take effect immediately and apply to all future messages from that business.
  • Reply HELP or INFO at any time for support information, or email [email protected].
  • Carriers are not liable for delayed or undelivered messages.
  • Mobile information, including phone numbers and SMS opt-in and consent data, is never sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

7. Acceptable Use

You may not use LeadHarvest to:

  • Send spam, unsolicited messages, or messages to recipients who have not provided express prior consent
  • Continue messaging recipients who have replied STOP, UNSUBSCRIBE, CANCEL, or any other opt-out keyword
  • Send messages relating to: adult content, hate speech, alcohol, firearms, tobacco, cannabis, CBD, controlled substances, prescription drugs, gambling, payday loans, debt collection, multi-level marketing, cryptocurrency promotion, or any other category prohibited by US wireless carriers under the A2P 10DLC framework
  • Harass, threaten, or abuse any person
  • Violate any local, state, or federal law, including the TCPA, CAN-SPAM Act, and CTIA messaging guidelines
  • Impersonate another person or business
  • Distribute malware, phishing links, or harmful content
  • Use URL shorteners other than those approved by the wireless carriers

We may suspend or terminate accounts that violate these rules — including accounts whose messaging triggers carrier complaints, exceeds carrier-imposed spam thresholds, or operates outside the registered campaign use case.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for delays or failures caused by circumstances beyond our reasonable control, including carrier outages or force majeure events.

9. Limitation of Liability

LeadHarvest is provided "as is." We are not liable for indirect, incidental, or consequential damages, including lost revenue or missed leads. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or an in-app notification. Continued use of the service after changes take effect constitutes acceptance of the new terms.
